EMERGENCY DESIGNATION OF SHELLFISH LANDS IN THE STATE OF NEW YORK AS UNCERTIFIED FOR THE HARVEST OF SHELLFISH

Pursuant to the provisions of Subdivisions 13-0307 (1) and (2) and Subdivision 13-0309 (1) of the Environmental Conservation Law and Section 42.17 and 47.4 of Title 6 of the Official Compilation of Codes, Rules and Regulations of the State of New York, and due to the extremely heavy rainfall and extraordinary amounts of stormwater runoff and localized street flooding associated with the continuous rainfall event from December 10, 2023 through December 11, 2023 which may result in conditions causing shellfish to be hazardous for use as food, I, Debra A. Barnes, Chief, Bureau of Shellfisheries of the Department of Environmental Conservation, hereby designate the shellfish lands described below as UNCERTIFIED effective immediately on December 11, 2023 and continuing until a determination is made that water quality in the affected areas meets the criteria for certified shellfish lands.

Accordingly, it is unlawful to harvest shellfish from the following areas:

1. Towns of Hempstead, Oyster Bay (south shore), Babylon and Islip: All that area of Hempstead Bay, East Bay, South Oyster Bay, and Great South Bay lying westerly of the northbound spans of the Robert Moses Causeway and north of Jones Beach Island.
2. Town of Brookhaven (South Shore): All that area of Moriches Bay and its tributaries lying westerly of a line extending southwest from the radio tower at the US Coast Guard Station in East Moriches to the northernmost point of the rock jetty on the western side of Moriches Inlet.
3. Towns of North Hempstead and Oyster Bay: All that area of Long Island Sound and Hempstead Harbor including their tributaries lying west of a line extending northeasterly from Matinecock Point to the Connecticut-New York State Boundary.
4. Towns of Oyster Bay (north shore) and Huntington: All that area of Oyster Bay Harbor and Cold Spring Harbor lying south of a line extending easterly from Rocky Point to Whitewood Point.
5. Town of Huntington: All that area of Northport Bay, Lloyd Harbor, Centerport Harbor, Duck Island Harbor and Huntington Bay lying southerly of a line extending easterly from the southernmost point of East Beach (at the north side of the mouth of Lloyd Harbor) to the southernmost point of West Beach (the southern tip of Sand City beach).
